Terms of Service

Worth saying plainly: this document describes how SHPMKR actually works today, but it has not been reviewed by a lawyer. If you are relying on it for a real business — particularly around consumer rights, tax, or data protection outside the UK and EU — have a solicitor read it before you do.

1. Who this agreement is between

These terms are between you — the person or business using SHPMKR to run a shop, referred to here as the merchant — and SHPMKR, the service available at shpmkr.com.

They do not govern the relationship between a merchant and their own customers. If you sell something through SHPMKR, that sale is a contract between you and your buyer. We are not a party to it.

2. Your account

You need a working email address, and you must confirm it before you can use the service.
You are responsible for keeping your password to yourself, and for anything done through your account.
One person or business per account. Do not create accounts to impersonate someone else.
You must be old enough to enter a contract where you live.

3. Your shop and what you sell

Everything on your shop — the words, the photographs, the products and the prices — is yours, and stays yours. You are responsible for it.

By using SHPMKR you confirm that:

You have the right to sell what you are selling.
You own or are licensed to use the images and text you upload. Do not upload other people's work as your own.
Your product descriptions are accurate, including any ingredient, allergen, material or safety information. We provide starting text for some categories as a convenience — checking that it is correct and complete for what you actually sell is your job, not ours.
Reviews shown on your shop are genuine. Publishing invented reviews is unlawful in most countries.
You comply with the law where you and your customers are, including consumer rights, labelling, and tax.

We may remove a shop that is being used for fraud, for selling something illegal, or to harm someone. Where we reasonably can, we will tell you why first.

4. Payments and money

Card payments are handled by Stripe, not by us. Money from your sales goes to your own Stripe account. We never hold your takings and we do not take a percentage of your sales.

You will also be bound by Stripe's own agreement when you connect your account, and Stripe decides whether it will serve you. Refunds, chargebacks and disputes are between you, your customer, and Stripe.

SHPMKR is currently operating Stripe in test mode. No real money moves until that changes and you are told so.

5. Plans and billing

The free plan is free, and is not a trial. It has limits — the number of products, a shpmkr.com web address, and a small SHPMKR mark on your shop — but it does not expire.

Pro costs $29 per month and adds your own domain, unlimited products, and removal of the SHPMKR mark. It renews monthly until you cancel.

You can cancel at any time from the billing page in your settings. Cancelling takes effect at the end of the period you have paid for — we do not refund part months. Your shop stays online afterwards on the free plan, and its limits apply again.

Card details are handled by Stripe. We never see or store them.

6. What we owe you

We will make a reasonable effort to keep the service running and your data intact. We cannot promise it will never be unavailable — no hosted service honestly can.

We will give you reasonable notice before removing a feature you rely on, or before making a change that would break your shop.

If we ever shut the service down, we will give you at least 30 days to export your products and customer orders.

7. Ending the agreement

You can stop using SHPMKR whenever you like, and ask us to delete your account and your shop. We will do it, subject to keeping order records where we are legally required to.

We may end your account if you break these terms in a serious way, or repeatedly after being asked to stop.

8. Liability

SHPMKR is provided as it is. To the extent the law allows, we are not liable for lost profits, lost sales, or losses arising from your use of the service.

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

9. Changes to these terms

We may update these terms. If a change materially affects you, we will email you before it takes effect. Continuing to use SHPMKR afterwards means you accept the updated terms.
